1. Agreement to these Terms

By using overtaken.xyz, submitting creator information, or continuing to payment, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Overtaken or submit a payment.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to make a purchase or submit a creator profile. Overtaken is not directed to children and does not knowingly solicit submissions from them.

3. What Overtaken is

Overtaken is a public leaderboard for creators. Creators submit a display name and at least one social profile for Instagram, TikTok, X / Twitter, YouTube, Twitch, or LinkedIn. Overtaken normalizes eligible handles and profile URLs into canonical links for display.

Overtaken has a Global leaderboard and a Today leaderboard. Global is the primary leaderboard and lists confirmed paid creator bids. Today lists confirmed bids paid during the applicable current calendar day. Rankings are ordered primarily by the amount successfully paid; where equal amounts exist, the earlier confirmed payment ranks first.

4. Bids, ranking, and changing positions

The minimum bid is $1.00. Valid bids progress in $0.05 increments from $1.00 through $2.00 ($1.00, $1.05, $1.10, and so on, up to $1.95 and $2.00). From $2.00 onward, valid bids progress in whole-dollar increments ($2, $3, $4, $5, and so on). You may voluntarily choose a higher valid bid using the site controls.

A payment purchases participation and placement in the leaderboard under these ranking rules. It does not purchase a guaranteed permanent #1 position, a guaranteed rank, a guaranteed duration at a rank, exclusivity, traffic, followers, engagement, business results, or social-media endorsement. Other creators may later make higher successful payments and overtake an entry.

5. Payment and confirmation

Checkout and payment processing are provided by Dodo Payments, which acts as Merchant of Record for transactions completed through its checkout. Dodo controls available payment methods and may handle applicable taxes. Overtaken does not directly store full payment-card numbers.

Your bid becomes a paid leaderboard entry only after Overtaken receives and verifies server-side confirmation from Dodo Payments. A browser redirect to a success or confirmation page does not itself establish that payment was completed. Overtaken validates the payment amount, relevant checkout information, and signed processor confirmation before recording a bid as paid.

Using Dodo checkout may also be subject to Dodo's applicable buyer, payment, and privacy terms. Review Dodo's information at dodopayments.com.

6. Refunds and cancellation rights

Refund requests may be handled through Dodo Payments and/or Overtaken as applicable, and are subject to applicable law and Dodo's transaction and refund rules. Digital leaderboard placement may begin promptly after successful payment. Where legally permitted, completion or delivery of that placement can affect cancellation or withdrawal rights. Nothing in these Terms excludes statutory consumer rights or remedies that cannot lawfully be excluded. Removal of a public entry does not automatically entitle you to a refund.

7. Public submissions and profile authorization

You intentionally submit information for public display. After a successful payment is confirmed, this can include your display name, submitted handles, canonical social-profile links, bid/payment amount, leaderboard rank, and payment or ranking time where relevant. This information may be publicly accessible and linked to third-party social-media profiles.

You represent that each submitted profile belongs to you or that you have sufficient authority to submit and promote it. You must not impersonate someone, make misleading identity claims, submit a profile to harass someone, submit fraudulent profiles, or use another person's identity without authorization.

8. Acceptable use and moderation

You must not use Overtaken in connection with unlawful content or activity, fraud or scams, impersonation, malware, abusive content, infringement of third-party rights, illegal products or services, payment-system manipulation, or any activity that violates applicable law.

Overtaken may reject, hide, remove, or suspend an entry reasonably believed to violate these Terms, applicable law, payment-provider requirements, or third-party rights. Any refund or other remedy will be considered separately under applicable law and relevant payment-provider rules.

9. Third-party platforms

Instagram, TikTok, X, YouTube, Twitch, and LinkedIn are independent third parties. Overtaken is not affiliated with, endorsed by, or sponsored by any of them unless expressly stated otherwise. A profile or link may become unavailable because of a platform's or user's actions. Overtaken is not responsible for third-party platform availability, content, policies, or actions.

10. Availability and corrections

Overtaken may experience maintenance, errors, outages, and display delays. Uptime is not guaranteed. Leaderboard displays can temporarily lag behind verified payments, and Overtaken may correct technical or data errors, including ranking displays, where reasonably necessary to operate the service accurately.

11. No guaranteed promotional result

Leaderboard placement does not guarantee clicks, exposure levels, followers, sales, engagement, sponsorships, revenue, partnerships, or any other promotional or commercial outcome.

12. Intellectual property

Overtaken's branding, design, code, and original content are protected by applicable intellectual-property laws. You retain rights you may have in your name, handles, and submitted information. You grant Overtaken a limited, non-exclusive, worldwide, royalty-free licence to host, reproduce, display, link to, and use that submitted material as needed to operate, display, and promote the leaderboard and service.

13. Security and service integrity

You must not use automated manipulation, attacks, scraping that materially harms the service, payment bypasses, false payment confirmations, leaderboard-record manipulation, or technical-vulnerability exploitation. You must not interfere with the integrity, security, or normal operation of Overtaken or Dodo checkout.

14. Suspension and termination

Overtaken may limit access to the service or remove submissions where reasonably necessary to address a breach of these Terms, unlawful activity, fraud, security risk, third-party rights issue, or payment-provider requirement. This does not affect rights or obligations that by their nature continue after removal, including payment reconciliation and legal compliance.

15. Disclaimers and limitation of liability

Overtaken is provided on an availability basis. To the extent permitted by law, Overtaken does not promise uninterrupted operation, error-free displays, or any particular promotional result. Nothing in these Terms limits or excludes a right, warranty, liability, or remedy that cannot lawfully be limited or excluded.

To the extent permitted by applicable law, Overtaken's total liability arising from a particular purchase or use of the service is limited to the amount paid by you to Overtaken through the relevant transaction. Overtaken is not liable for indirect, incidental, special, consequential, or punitive losses, or for third-party platform actions, except where applicable law does not permit the limitation. Your mandatory consumer protections remain unaffected.

16. Indemnity

To the extent permitted by law, you will indemnify Overtaken against third-party claims, losses, and reasonable costs arising from your unlawful submission, infringement, impersonation, fraud, or material breach of these Terms.

17. Changes to these Terms

Overtaken may update these Terms prospectively. Material updates will be reflected by changing the Last updated date above. Your continued use after an updated version takes effect is subject to the updated Terms.

18. Governing law

Nothing in these Terms limits consumer protections or other rights that apply mandatorily under the law applicable to you.
